Q1: What is the primary statutory basis for determining seniority?

Answer:
Under the statutory framework, seniority for nomination and appointment is determined strictly by the date of permanent appointment in a specific cadre. Specifically:

  • Commencement of Duty: Seniority is established from the date an individual commences duty in a permanent capacity in the institution.
  • Sequence of Appointment: The order or sequence in which permanent appointment orders are issued determines relative seniority.

Q2: Is seniority calculated based on total overall teaching experience or is it cadre-based?

Answer:
Seniority is strictly cadre-based, not calculated on total overall length of service as a teacher.

  • Cadre Hierarchy: Statute 143(1) establishes a clear structural hierarchy where a Senior Professor / Professor is senior to an Associate Professor, and an Associate Professor is senior to an Assistant Professor.
  • Cadre-Specific Length: Total years of service rendered in a lower feeder cadre (e.g., as an Assistant or Associate Professor) cannot be added or used to supersede someone who entered a higher cadre (e.g., Professor) earlier.



Q3: How is relative seniority determined among teachers within the same cadre?

Answer:
Within any specific cadre (e.g., among Professors or among Associate Professors), seniority is decided on the basis of their date of joining duties in that cadre in the University Schools, Departments, Conducted Colleges, or Institutions.


Q4: How is a tie resolved if two or more members commence duty on the exact same date?

Answer:
If two or more members join duty on the same day following a selection process, their relative seniority order is determined strictly by their merit ranking in the interview process (i.e., the candidate ranked higher by the selection committee receives the higher seniority ranking).


Q5: Is there any difference in seniority between directly recruited teachers and those promoted under the Career Advancement Scheme (CAS)?

Answer:
No. Statute 143(2) explicitly mandates that there shall be no discrimination or distinction in seniority between directly recruited teachers and teachers promoted under the Career Advancement Scheme (CAS) within any cadre under any circumstances. Inter-se seniority is determined purely by the effective date of joining/appointment in that cadre.


Q6: How do seniority rules apply to nominations on governing bodies like the Board of Management (BoM), Executive Council (EC), and Academic Council (AC)?

Answer:
The Act and Statutes command that nominations of teacher, Head, and Dean representatives to major statutory bodies be made on a seniority basis, by rotation.

  • Cadre Requirement: Statutes 21(C)(1), 22(C)(1), and 23(C)(1) uniformly mandate that "Seniority for nomination shall be on the basis of the date of permanent appointment from the concerned cadre".
  • Rotational Representation: Representatives from university departments, colleges, and cadres are rotated so that departments or units previously represented are passed over to give turn to the next in order of seniority.

Q7: What happens to a teacher's seniority if they go on deputation, retain a lien, or hold a public office (e.g., MLA/MP)?

Answer:

  • Deputation with Lien: If a member is sent on deputation or outside posting with official consent while retaining a lien on their post, their seniority remains unaffected.
  • Voluntary Departure / Re-appointment: If a member leaves voluntarily or is redeployed and later reappointed in a permanent capacity, their seniority starts fresh from the date of re-commencement of permanent employment.
  • Public Service (MLA/MP): Under Section 44 of the Act and Statute 294(4), if a teacher or employee is elected/nominated as a Member of the State Legislative Assembly or Parliament, the period of public service must be counted toward seniority, increments, and pension.

Q8: How are casual vacancies on statutory boards or committees filled?

Answer:
Under Statute 45, if a vacancy occurs in any authority, council, or committee, it must be filled by nominating the next senior person from the respective cadre within 30 days for the remaining tenure.


Q9: How is seniority applied when appointing the Head of a University Department (HOD) or Chairperson of a Board of Studies (BoS)?

Answer:

  • Head of Department (HOD): The Vice-Chancellor appoints HODs by rotation for a 5-year term, adhering to cadre hierarchy first (Senior Professor/Professor \(\rightarrow\) Associate Professor \(\rightarrow\) Assistant Professor) and selecting the senior-most teacher in that cadre.
  • Board of Studies Chairperson: Under Statute 25(5), the Chairperson of the Board of Studies is designated as the senior-most member of the Board of Studies as per appointment seniority.
